using the ShowStage Website, including access or use through a
computer, mobile device, or mobile application, you accept and agree
to be bound by these Terms of Service regardless of whether or not
you choose to register with us. If you do not accept these terms and
conditions, do not use the Website.
You affirm that you are either
more than eighteen (18) years of age, or an emancipated minor, or
possess legal parental or guardian consent, and are fully able and
competent to enter into the terms, conditions, obligations,
affirmations, representations, and warranties set forth in these
Terms of Service, and to abide by and comply with these Terms of
Service, and are not a person barred from using the Website under
the laws of India or other applicable jurisdiction.
Users under the age of eighteen (18) (a "Young User") are expressly prohibited from using the ShowStage Website Services, as defined below.
- Young Users who would like to participate in any of the Websites must have their parent or legal guardian (a “Parent Registered User”) register to use the Websites, using the Parent Registered User’s name, email, and credit card information, and consent to and upload the Young User’s information to the Websites.
- Parent Registered Users are responsible for directly engaging with all Services on the Websites, including but not limited to submitting applications and messaging other users, updating the settings of and terminating their account and thereby use of the Websites on behalf of the applicable Young User.
- For purposes of these Terms of Service, Parent Registered Users and their Young Users are deemed to be Users as used in these Terms of Service. By registering as a Parent Registered User, you hereby represent, warrant, understand, agree to and accept these Terms of Service and any applicable additional terms in their entirety on behalf of yourself and your Young User whether or not you use any of the Websites.
- You further understand and agree that you will ensure your Young User’s compliance with these Terms of Service and that you are responsible for any noncompliance by your Young User.
If you are a Parent Registered User, you also agree that you are responsible for using and monitoring the account on behalf of your Young User .
If a parent or guardian believes that any Website has collected information of a child under the age of thirteen (13), or under the age of sixteen (16) if they reside in a country within the India, without proper consent,please contact ShowStage at [email protected]
ShowStage may revise and update
these Terms of Service from time to time in our sole discretion. All
changes are effective immediately when we post them and apply to all
access to and use of the Website, including any products, software,
or mobile applications provided by ShowStage or the Website,
thereafter. However, any changes to the dispute resolution
provisions set forth in Governing Law and Jurisdiction section will
not apply to any disputes for which the parties have actual notice
on or prior.

the Websites. You acknowledge and agree that ShowStage, and its

ShowStage's intellectual property, including, without limitation, its trademarks and trade dress, may not be used in any manner that is likely to cause confusion among users or in any manner that disparages ShowStage. All rights are expressly reserved.

Content that ShowStage deems obscene, defamatory, or libellous in

You are solely responsible for all User Provided Content that you make

or for any loss or damage of any kind incurred as a result of User

acquires no title or ownership rights in or to any User Provided

ownership rights in the User Provided Content you submit to ShowStage.

problems with those opportunities, goods, services, or other materials
will be sought from the third-party provider and not from ShowStage.

by ShowStage of that opportunity, product, service, material, or

6. Limited License
Subject to your compliance with these Terms of Service, ShowStage grants you a limited, personal, non-exclusive, non-commercial, revocable, non-assignable, and non-transferable licenseto:

- Create profile pages on the Websites for non-commercial and private use;

You may not take any action to jeopardise, limit or interfere with ShowStage’s ownership of and rights with respect to the Websites or any Content. The use, copying, sale, leasing, renting, lending, distribution, modification, downloading, creating of derivative works, posting, or publication by you, directly or indirectly, of any Content, or any other use of such Content, except pursuant to the foregoing express limited grant of rights, is strictly prohibited. Bots, crawlers, spiders, data miners, scraping, and any other automatic access tool are expressly prohibited. You acknowledge that any unauthorised copying or unauthorised use of the Websites or of any Content is a violation of these Terms of Service and is strictly prohibited. (a) Any material that is false, unlawful, threatening, tortious, disparaging, abusive, libellous, defamatory, obscene, vulgar, offensive, pornographic, profane, racist, sexually explicit, ethnically or culturally offensive, indecent, harassing, or that promotes violence, racial hatred, terrorism, or illegal acts, or anything that in ShowStage's sole discretion is otherwise objectionable; or
(b) Information, software, content, or other material that violates, plagiarises, misappropriates or infringes the rights of third parties including, without limitation, copyright, trademark, patent, trade secret, rights of privacy or publicity, confidential information, or any other proprietary right; or
(c) Material of any kind that restricts or inhibits any other user's uninhibited use and enjoyment of the Websites or interferes with, overburdens, impairs or disrupts the Websites, including material that contains a virus, Trojan horse, time bomb, worm, spyware, adware, malware, bot, any automated system, such as scripts, or any other harmful component; or
(d) Any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, requests for money, petitions for signature, or any other form of solicitation; or
- Use or attempt to use another person's information, account, password, service, or system except as expressly permitted; or
- Impersonate another person or entity; or
- Engage in any conduct that in ShowStage's sole discretion restricts the ability of any other person to enjoy the use of the Websites; or
- Solicit or restricts the ability of any other person to enjoy including telephone numbers, addresses, last names, email addresses, or any other kind of information about users.

8. User Accounts
The creation of a User account may be required for the use of certain portions of the Websites (e.g., email, newsletters, competitions, forums, content downloads, and promotions). As part of ShowStage’s registration process, you will select a username and password and be asked to submit, among other things, your email address. You agree that all information you provide to ShowStage for purposes of creating a user account (the “User Information”) will be true, accurate, current, and complete and your failure to provide such information will constitute a breach of these Terms of Service and may result in the immediate termination of your account. All information about you including your User Information, any information obtained by ShowStage as a result of your use of the Websites, and any information stored or transmitted in any way on or through the use of the Websites is subject to ShowStage's Privacy Policy, which can be found at https://www.showstage.in/privacy-policy/. ShowStage's Privacy Policy is incorporated into these Terms of Service by this reference.
You understand that you may not:
- Select or use a name of another person with the intent to impersonate that person;
- Use the rights of any person without authorisation; or
- Use a name that ShowStage, in its sole discretion, deems inappropriate.
You agree that any information that you provide to the Websites, including but not limited to User Information,
shall be true and accurate and current, and you are responsible for updating such information to keep it true, accurate, and current. If you create a user account with the Websites, you accept responsibility for all activities that occur under your account or password and you agree you will not sell, transfer or assign your user account. You are responsible for maintaining the confidentiality of your password, if any, and for restricting access to your computer so that others may not access any password-protected portion of the Websites
(including the Premium Services) using your name, user name or password in whole or in part.
Each User name permits one person to access the password-protected portion of the Websites (including the Premium Services), and you shall not share the user name and password with any third party. You shall be
solely responsible for any and all use of the Websites, including without limitation, any and all charges incurred by a third party, under or using your user name and password. If at any time you should learn or suspect that your password has been compromised, you shall promptly notify Customer Service at 8433014097 and confirm such notice in writing. Upon receiving such telephonic and written notice, ShowStage will assign a new password to you without charge.
You agree that any unauthorised use of the Websites (or any Content derived therefrom) by you or by anyone using your user name or password may result in immediate suspension or termination of your user account by ShowStage, in its sole and absolute discretion, without refund of any pre-paid fees. You
represent and warrant that the information provided during the subscription process is true and accurate and agrees to update the information thereafter in the event of any changes.
ShowStage reserves the right to terminate, without notice, your access to and use of the Websites in the event that you provide any false information to ShowStage as part of the subscription process, without refund of any pre-paid fees. ShowStage reserves the right to terminate, without notice, your subscription and access to the Websites for any conduct that ShowStage, in its sole discretion, believes is in violation of these Terms of Service, any applicable law, or is harmful to the interests of another User, service provider, or ShowStage. In the event of such termination, you will continue to be
liable for applicable fees for the period prior to termination, together with such other remedies as to which ShowStage may be entitled.

To create an account, you need to provide truthful information. You are responsible for keeping your password confidential and not sharing it with anyone. You are also responsible for any activity that happens under your account.
If you think someone else is using your account, contact customer service. ShowStage can terminate your account if you violate the terms of service or provide false information.
9. Payment Terms
The act of placing an order constitutes an offer to join, subscribe, or purchase a ShowStage membership as appropriate. All offers are subject to our acceptance (which is at our sole discretion) and these terms (Payment Terms).

You may opt to enhance your membership with "Additional services." Additional services encompass any supplementary features, services (including third-party services), products, or content that you may choose to add to your existing membership subscription. These services are supplementary and not included within base membership plans. All Additional services are subject to availability and may be offered on a limited basis. We reserve the right to accept or deny any request for Additional services at our sole discretion. The cost and payment terms for Additional services will be as specified at the time of purchase, exclusive of taxes, and will follow the main subscription’s payment terms. Additional services commence upon activation, auto-renew in line with the subscription, and can be cancelled in accordance with the cancellation policy within these Terms.
We require payment of the entire price for the services that you order before your order can be accepted, either by payment in full or by setting up a valid Direct Debit mandate or recurring card payment. It is not our policy to offer credit accounts for payments. Please do not be offended if we refuse your request.
If you are a brand new ShowStage Member, please ensure you have read and understood the terms around your cancellation period, as detailed in these Payment Terms. For certain ShowStage membership groups, if paying by card, your card may be pre-authorised, which creates a temporary hold on your card and reserves funds until payment is taken or the transaction is cancelled.
When purchasing a casting subscription, once you have provided us with your company/individual information you will proceed to a checkout screen. After you submit your application to be a Casting Subscriber, our online payment provider will process your payment automatically. This does not confirm our acceptance of your order. We will subsequently verify your professional credentials and review your first casting draft if you are using the Jobs Feed. We reserve the right to refuse your order and refund your subscription purchase costs at any stage. We additionally reserve the right to refer to other professional bodies, such as Equity, if we have specific concerns regarding company background or information supplied (such as terms of employment or similar).
We are not responsible for any additional fees your own bank may charge.
We accept Visa, MasterCard, Debit Card, Rupee Card and UPI Payments. We do not accept American Express or Diners Card.
reserves the right to set a minimum refund threshold,If we need to refund you for any reason, we will submit the refund to the card, or other payment method, on which the order was placed. ShowStage and refunds may not be provided if the value of the refund falls below that level.
Once you have submitted your payment details, your order will automatically proceed and we will not be able to stop the payment going through at this stage. Should you have any concerns regarding a payment that has been sent through for processing, please contact us.
If you receive an invoice from us, or receive a Service from us without paying in advance or on the day, the payment terms will be stated on the invoice, if applicable, or payment will be due immediately. We reserve the right not to provide you with additional Services, even if a deposit or full payment has been made, until all due payments have been received.
ShowStage reserves the right to charge interest monthly in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 for late settlement of accounts from the due date up to the receipt of payment. We may also seek to recover any related debt collection agency costs.
You can also pay your membership fee by annual or monthly. The terms of your payment method may be determined by agreements between you and the financial institution, debit/credit card issuer, or other provider of your chosen payment method.
If you purchase a subscription using a debit or credit card on a recurring annual or monthly subscription basis, also referred to as a Continuous Payment Authority (CPA), you agree that we and/or our authorised service providers may store your payment information which may include tokenised card or bank account details. By choosing this payment method you authorise us to set up and use CPA as the payment method using the details you have provided, and you give us authority to renew your subscription on a continuous basis until otherwise notified.
We reserve the right to make price changes to future membership fees. This will not affect your payments already made. We will always notify you of any changes in fees in advance of your annual or monthly membership renewal.
We reserve the right to refuse or cancel membership/services for any ShowStage Member, agent, casting subscriber, or casting invitee. In the event that membership or subscription is cancelled or refused at will by us, a full refund will be given (see Right to refuse orders for refund exemptions).
We additionally reserve the right to terminate or suspend ShowStage memberships, subscriptions, and accounts temporarily or permanently where:
(a) Our staff or other persons are subject to abusive, offensive, or threatening behaviour;
(b) Information supplied cannot be validated;
(c) There are fraudulent applications or activities (or where there is legitimate suspicion of same);
(d) The vetting/joining criteria are no longer met;
(e) Having the person/company on the Platform would be detrimental to other person(s)/company(s) using the ShowStage Platform;
(f) We may see information about a person/company in the public domain which suggests having them on our Platform may cause reputational damage to ShowStage or be detrimental to other person(s)/company(s) using the Platform; and
(g) Where we are complying with sanctions regulations in countries where we operate.
Please note that we cannot always act on complaints received or information that becomes known.
If the Service you have ordered is no longer available we will notify you as soon as possible, and any sum debited by us from your credit or debit card, for Services not already received, will be re-credited to your original payment method. We will not be obliged to offer any other replacement or compensation in the event of this happening.
